§ C-2-2. Mayor and mayor pro tem.

    The mayor shall preside at meetings of the council, and shall ensure an agenda is available for council meetings. He shall be recognized as head of the city government for all ceremonial purposes and by the governor for purposes of military law. He shall have no administrative duties except to sign such written obligations of the city as the council may require. He shall have the right to vote on questions before the council only in case of a tie, adoption of the annual budget, and on motions to appoint, suspend, or remove the city manager, city attorney and city clerk. The mayor shall present annually a public address on the state of the city at a time and place of his designation, and shall deliver, from time to time, such other messages to the council and citizens of the city as he deems appropriate.

    At the first meeting after the time prescribed for the beginning of the terms of newly elected councilmembers, or as soon thereafter as practicable, the council shall elect from its membership a mayor pro tem, who shall exercise all the powers of the mayor except those noted below until the next such first meeting. The mayor pro tem shall act as mayor during the absence, disability, or suspension of the mayor, or, if a vacancy occurs in the office of mayor, until another mayor is elected by the council for completion of the unexpired term and qualifies. If the office of mayor pro tem becomes vacant, the council shall elect from its membership another mayor pro tem for completion of the unexpired term. The mayor pro tem shall cast only one vote on each issue before the council and shall not have the authority to veto any ordinance.

    c.

    When the mayor is absent and the question before the council requires five (5) affirmative votes for passage and the votes cast result in a tie of four affirmative votes and four (4) negative votes, the matter will be continued or rescheduled for the next regular meeting of the council when the mayor will be in attendance.
