§ 23-7-703. Possess, operate or use a radar detector in a commercial motor vehicle.

  • It shall be unlawful for any person to:

    1.

    Possess, operate or use a radar detector while operating or as a passenger in a commercial motor vehicle;

    2.

    Operate a commercial motor vehicle in which a radar detector is installed or present; or

    3.

    Install or have installed a radar detector in a commercial motor vehicle.

    Any person who violates any provision of this section shall, upon conviction thereof, be guilty of a misdemeanor offense and shall be punished by a fine of not more than five hundred dollars ($500.00) or by imprisonment for not more than ten (10 days); for a second such conviction within one year after the first conviction by imprisonment for not more than twenty (20) days; upon a third or subsequent conviction within one year after the first conviction by imprisonment for not more than six (6) months, or by both such fine and imprisonment.
