§ 6-1-1-108. Expiration of permit.

  • A.

    Permits issued for new construction or addition shall expire one (1) year from the date of issuance.

    B.

    Permits issued for remodeling or renovating existing structures and/or any other work, excluding new construction and additions, requiring a permit shall expire one hundred eighty (180) days from the date of issuance or as specifically stated elsewhere in this code.

    C.

    Permits for the remodel and/or reconstruction of a structure rendered unsafe or uninhabitable by an emergency event, such as a fire or severe weather event, shall expire ninety (90) days from the date of issuance. Any permit extensions shall be valid for a period set by the building official, not to exceed ninety (90) days from the date of issuance.

    D.

    A permit for reconstruction, remodel or repair of a structure considered by the city council as dilapidated shall expire thirty (30) days from the date of issuance. Following said thirty (30) day term, and upon a determination by the city manager or his designee, that work is progressing satisfactorily, a thirty (30) day extension may be granted. No more than two such extensions may be granted after the permit's initial thirty (30) day term without specific authorization by the city council. The permit shall state the date of expiration. Upon permit's expiration, all work shall cease unless an extension is granted. The dilapidated structure must pass a City final building inspection. Unoccupied industrial and commercial structures must be issued a certificate of completion signifying compliance with all applicable Code provisions. Occupied industrial and commercial structures must be issued a certificate of occupancy. Residential structures, whether occupied or not, must be issued a certificate of occupancy. A structure shall remain deemed dilapidated until it passes a final building inspection and a certificate of occupancy or certificate of completion is issued.

    E.

    An application to extend a permit must be made prior to the permit's expiration. A permit extension will only be granted if it is determined by the building official that progressive and continual work has been made toward the completion of the project, or circumstances outside of the contractor/owner's control have prevented the completion of the project. The permit extension fee shall be as provided in the fee schedule and said permit extension shall expire one hundred eighty (180) days from the date of issuance or as specifically stated elsewhere in this code. If an application for a permit extension has not been submitted prior to the permit expiring or if the building official determines that progressive and continual work has not been made toward the completion of a project, a new permit application shall be submitted and approved prior to work continuing on the project. Anyone found continuing work without a valid permit will be subject to citations pursuant to Section 1-119 of this code and/or subject to the late permit fee for any new permits. Abandoned or incomplete projects may be declared a public nuisance in accordance with Chapter 15 of this code.
